Privacy policy

 

Information obtained from the customer (hereinafter called the “Customer Information etc”) by cocoa motors.Inc. (hereinafter called the "Company”) when selling or using the products and services provided by the Company (hereinafter called the "Service") will be handled as follows.

 

Article 1 (General provisions)

 

To protect Customer Information etc, the Company will comply with the Act on the Protection of Personal Information and other related laws and regulations, and will endeavor to properly handle and protect Customer Information etc, including personal information.

This policy includes and applies to all customers who purchase or use the Service (including prospective users who have made inquiries or other requests to us in order to consider the use of this service. Hereinafter the same definition shall apply). In addition, when the Company specifies the handling of Customer Information etc in the privacy policy, other policies regarding personal information protection or the usage contract etc., if any provisions conflict with this policy, this policy shall take priority.

Unless otherwise specified, the terms used in this policy are subject to the content stated in the Terms of Use of the Service.

Regarding affiliated services provided by businesses that provide services that are affiliated with the Service, and other services provided by parties other than the Company (hereinafter called "Affiliated Services", and the businesses that provide such services called the "Affiliated Businesses"), the provisions of this policy do not apply. For the handling of customer information by the Affiliated Service, please refer to the privacy policy etc., separately established by the Affiliated Business.

 

Article 2 (Information to be acquired by the Company and its acquisition method)

 

During sales or usage of the Service, the Company will obtain Customer Information etc, including personal information ("Personal information" defined by Article 2, Paragraph 1 of the Act on the Protection of Personal Information. The same definition shall apply hereafter) as specified below.

Information obtained from customers (hereinafter called the "Customer Information".)

The Company will collect the customer’s name, gender, date of birth, address, email address, telephone number, and account ID and password of the Service, as well as other information about the customer that the Company specifies.

The Company may obtain personal identification documents (i.e. driver's license, health insurance card, copy of resident card, etc.) to verify the customer’s identity, as well as the information contained in those documents as required by law.

Information collected by the Company during sales or usages of the Service

Device information

Upon sales or usage of the Service via the customer’s device or mobile device, the Company may collect the customer’s device information (i.e. device ID information, etc. that may be used for identification purposes) in order to maintain or improve the Service, or prevent fraud.

Information regarding log information, activity history and service usage status

The Company may collect information regarding purchases made while using the Service, or, during usage of the Service, automatically generated and stored IP addresses, the time and date of requests made by the customer, operation history when making purchases while using the Service or during usage of the Service, or customer purchase history within the Service. This information is collected for the continued provision, maintenance, and improvement of the service, as well as for the purpose of preventing fraud, etc.

Cookies and anonymous IDs

During sales or usage of the Service, the Company may use technology called "cookies" and/or similar technologies. Cookies are an industry standard technology that allows web servers to identify one’s computer. Cookies can identify the customer’s computer but not the customer’s personal identity. Although it is possible to disable the cookie function by changing the settings on the electronic device, please be aware that in such cases, the customer may no longer be able to use the Service.

When acquiring Customer Information etc, the Company will obtain it properly, without utilizing misleading, false or otherwise improper means. In addition, when the Company acquires Customer Information etc by a method other than through sales or usage of the Service by the customer, the Company will notify or announce the purpose of use in advance.

 

Article 3 (Purpose of use)

 

The Company will properly handle Customer Information etc obtained through the sale or usage of the Service within the scope of the following purposes. It will not be used beyond the scope of the purpose of use without the consent of the customer.

The Company may change the purpose of use in the preceding paragraph to an extent reasonably recognized to be related to the purpose of use before the change, and in the case of change, the Company will notify the customer via the Service, or by posting on the website operated by the Company, or via some other easy-to-understand method.

 

Article 4 (Third party provisions)

 

As a general rule, the Company will not provide personal information to a third party without the consent of the person concerned. However, in the following cases, the Company may provide personal information without the consent of the customer to the extent that it does not violate relevant laws.

When required by law

In order to take necessary measures when, during usage of the Service, the customer acts or tries to perform an act that harms the interests of others, violates public order and morals, or violates the Terms of Use of the Service

When it is necessary to protect the life, body or property of a person, and it is difficult to obtain the consent of the person concerned

When it is particularly necessary to improve public health or promote the sound development of children, and it is difficult to obtain the consent of the person concerned

When it is necessary for a national institution or local public entity, or a person with a related consignment, to carry out affairs stipulated by law, and in attempting to obtain the consent of the person concerned, there is a risk of the execution of these affairs being hindered

When the business, including assets such as the customer's personal information, is succeeded due to a merger, company split, business transfer, or other reasons.

 

Upon obtaining consent from the customer, when the Company provides the customer’s personal data ("Personal data" defined by Article 2, Paragraph 6 of the Act on the Protection of Personal Information, and the same definition shall apply hereinafter) to a third party, the Company will create and store records regarding the following items.

Notwithstanding the provisions of Paragraph 1, if the Company reports to the Personal Information Protection Commission (PPC), Personal Data included in the items of the Customer Information etc included in communications made with third parties in the table of Paragraph 1, Article 3 may be provided through such methods as sending by email. However, if the customer does not wish to provide the customer’s Personal Data to a third party, the customer may notify the Company according to the procedure stipulated in Article 10 of this policy and the Company will stop providing it to the third party.

 

Article 5 (Entrustment of handling personal information)

 

The Company may entrust the handling of all or part of the personal information obtained from the customer to a third party within the scope necessary to achieve the purpose of use. In this case, the Company will draw a confidentiality agreement, etc. in accordance with the content of this policy in advance with the subject of the entrustment, and conduct necessary and appropriate supervision so that the subject of the entrustment can properly manage the information.

 

Article 6 (Shared use)

 

The Company may jointly use personal information acquired from customers with Affiliated Businesses and other third parties to the extent necessary for providing Affiliated Services, and for developing services. In this case, the Company shall announce in advance the items of the jointly used information, the scope of the persons engaging in the joint usage, the purpose of the persons engaging in the join usage, and the name of the person responsible for the management of the information.

 

Article 7 (Information collection module)

 

The following information collection modules selected by the Company may be incorporated into the Service, in order to analyze information such as the usage status and advertising effectiveness related to the Service.

Along with this, the Company may provide Customer Information to the providers of the following information collection modules. These information collection modules collect Customer Information without including personally identifiable information, and the collected information will be managed based on the privacy policy and other provisions established by each information collection module provider.

Article 8 (Behavioral Advertising)

 

The Company may collect, store and use the following information by using the information collection module specified in the preceding article when providing the Service or an Affiliated Service, in order to carry out targeted advertisements (an advertising method that delivers advertisements according to the needs and interests of customers) by the Company or third parties such as advertisement distributors.

 

Information on behavior history and service usage (i.e. information that may be accumulated and used for analysis of customer needs and interests, such as the usage history of the Service, etc., which cannot be used to identify a specific individual.)

Device information

The Company will provide information to businesses who distribute behavior targeting advertisements (hereafter called “Advertisers”), for the purpose of delivering useful information to customers by delivering optimal advertisements customized to the needs and interests of customers, based on the information collected based on the preceding paragraph.

The handling of each information by the Advertisers shall comply with the privacy policy and other conditions established by the Advertisers.

 

Article 9 (Safety management system)

 

In order to prevent the leakage, loss or damage of Customer Information etc, and to protect Customer Information etc, the Company implements access restrictions on personal information files, limits the minimum necessary number of access authority holders, and takes necessary and appropriate measures for the safety management of Customer Information etc, such as the introduction of security software to prevent unauthorized access.

The Company, with the representative director as the person holding responsibility for the management of personal information, will properly manage Customer Information etc and carry out continuous improvement.

 

 

Article 10 (Change of this policy)

 

The Company shall review the operational status regarding the handling of Customer Information etc at appropriate intervals, shall strive for continuous improvement, and may change this policy from time to time as necessary.

The company will announce the changed policy by posting it on the Service or on the website operated by the Company, or via other easy-to-understand methods. However, when making changes that require the consent of the user by law, the customer's consent will be obtained by a method separately determined by the Company.
